With Massive Prisoner Release, Averting Fatal Reentry

This November marks the beginning of the largest prisoner release in this country's history. Just over the first weekend, the federal prison system discharged over 6,000 inmates who saw their drug-related sentences reduced as a result of recent reforms. An estimated 40,000 additional federal prisoners will be eligible for early release in the coming months. This is just one part of a broader drive to slash senselessly harsh sentences for drug crimes, reduce prison overcrowding, and generally move away from mass incarceration and the War on Drugs.

Although generally positive (and long overdue) for the inmates, their families, and the taxpayer, this monumental de-incarceration effort is also a source of grave risk. Few will be surprised to hear that the U.S. is in the midst of an overdose crisis, but there is little recognition that re-entering individuals are nearly 130 times more likely to die of an overdose in the first two weeks after their release than the population as a whole. Multiple factors drive this astronomical risk, including low tolerance after a period of abstinence, use of drugs from unfamiliar sources and of unknown strength, mixing multiple substances, and the disorienting chaos inherent to the reentry process.

It is easy to cast post-incarceration substance use -- and consequent overdose -- as the individual's character weakness and recklessness. But we know that relapse is a foreseeable consequence of the chronic nature of addiction. The good news is that science provides clear guidance on how these post-release deaths can be prevented; the bad news is that we are doing almost nothing to avert them.

Targeted overdose education, resuscitation training, and distribution of naloxone -- the opioid antagonist -- are highly effective in cubing overdose fatalities. Research from the U.S. and abroad suggest that brief overdose prevention efforts are easily integrated into existing pre-release programming, drastically cutting reentry overdose risk. Yet, only a handful of U.S. programs are currently providing such training to inmates before they re-enter the community; none cover federal prisoners.

Medication-assisted treatment (MAT) and other evidence-driven care behind bars have also shown to cut overdose risk upon re-entry, especially when released individuals continue with their treatment in community-based settings. We know that upwards of 80 percent of incarcerated individuals are estimated to require such treatment, but only a small percentage receive any help with their substance use issues. Although there are some federal and state efforts to remedy this, access to science-based MAT behind bars remains dismally rare. Once on the outside, former inmates face a barrage of barriers to community-based MAT and other services, including the need to re-enroll in health insurance coverage and long wait lists plaguing our byzantine drug treatment sector. The Affordable Care Act (a.k.a. Obamacare) includes several provisions that may help address these issues.

Transitioning into community after time behind bars is disorienting and stressful, so overdose prevention must also be incorporated into other support programs already in place. Instead, many institutions supposed to facilitate re-entry may inadvertently aggravate overdose risk. For instance, most halfway houses offer zero overdose education, while some transitional housing organizations espouse ill-informed policies prohibiting MAT. Community supervision officers are optimally situated to assess -- and reduce -- overdose risk among people on probation or parole, but there is currently almost no effort to engage them in this vital work.

After years of stubborn inaction, federal sentencing reform and other de-incarceration efforts are finally gaining momentum. In adapting to this paradigm shift, criminal justice institutions need to take ownership of the overdose risk facing inmates after they leave custody and the opportunities to address it. Tragically, this potential goes almost completely unrealized. As we celebrate progress, we must demand that the criminal justice system do more to ensure that spending time behind bars does not translate to a death sentence for so many.

Allsup, a nationwide provider of Social Security disability and veterans disability appeals services, will host an interactive free Web event, “True Help for Veterans with Disabilities” on Tuesday, Nov. 10, from 11 a.m. to 12:30 p.m. CST.

Help with VA Disability Appeals

According to the U.S. Department of Veterans Affairs (VA), more than 3.9 million veterans receive VA disability benefits. About 294,000 veterans began receiving VA compensation benefits in 2014.

“Currently, the average processing time for an initial decision is 136 days,” said Brett Buchanan, VA-accredited claims agent with the Allsup Veterans Disability Appeal Service®.

The number of veterans with appeals pending is growing.

“Veterans have one year to appeal if they are denied or don’t agree with their rating,” Buchanan explained. “The VA publishes in 2014 it took an average of 330 days for that appeal to be decided by the Regional Office. If a veteran appealed that second decision to the Board of Veterans’ Appeals, or BVA—it took on average 1,038 days for the BVA to make a decision. Appeals volume has grown 26 percent since 2013.”

The most prevalent service-connected disabilities include post-traumatic stress disorder (PTSD), tinnitus, hearing loss, knee and back pain and scarring. Veterans filing for VA compensation have an average of five different service-connected disabilities.

“The combination of disabilities, the complexity of the VA disability process, and scores of backlogged claims highlight the need to help veterans understand their representation options,” Buchanan said.

Help with Mental Health and Wellness

According to NAMI, military and veteran families experience high rates of stress and mental health symptoms. These may be related to multiple deployments, the challenges of life in the armed forces, and changes occurring among service members, veterans and their families.

Ingrid Yee, NAMI manager of Military and Veteran’s Policy and Support, will share information about NAMI Homefront—a free educational program for families, caregivers and friends of military service members and vets with mental health conditions.

Additional mental health resources and perspectives from veterans living with mental illness will be shared during the Web event, which includes an interactive chat room.

Help Understanding ‘Presumptive’ Conditions

The VA presumes that specific disabilities diagnosed in certain veterans were caused by their military service, a basic requirement for VA disability. One example of a presumptive condition is Parkinson’s disease among Vietnam veterans exposed to Agent Orange.

Linda Gulas, APDA veteran information and referral coordinator, will share resources available through the Dedicated Veteran Information and Referral Center for Parkinson’s disease.

Information on all VA presumptive conditions will be available during the Web event.

Help with Social Security Disability Insurance (SSDI)

The Social Security Administration (SSA) has initiatives designed to speed up the disability claims process for veterans meeting certain qualifications, but these efforts do not guarantee benefits for veterans seeking SSDI.

Among veterans receiving VA compensation, it’s estimated from 3.6 percent to 15.9 percent also receive SSDI benefits, based on data from the Center for Retirement Research and a 2007 Veterans’ Disability Benefits Commission report. The commission found indications that veterans with the most severe disabilities did not know they were eligible to seek SSDI benefits, or they were denied benefits by Social Security.

“Veterans must meet very specific criteria to qualify for the SSA’s expedited programs,” said Tai Venuti, Allsup manager of Strategic Alliances. “During the Web event, I will explain the criteria for each program and how an SSDI representative can advocate for them to receive the benefits they deserve.”

Obama administration defends troubled health care co-ops

WASHINGTON (AP) — The Obama administration defended the health care law's struggling insurance co-ops Tuesday, suggesting to Congress that cutbacks demanded by lawmakers themselves put added pressure on an altruistic alternative to mega-insurers. [...] administration official Mandy Cohen told lawmakers that co-ops have played an important role in fostering competition and choice in the law's health insurance markets, now in their third year. Cohen is chief operating officer at the Centers for Medicare and Medicaid Services, which oversees government health insurance programs. Co-ops entered the health insurance market with a number of challenges, including building a provider network and customer support, no previous claims experience on which to base pricing, and competition from larger, experienced issuers. If This Kentucky Republican Becomes Governor, Hundreds Of Thousands Could Lose Their Health Insurance

WASHINGTON -- When Kentucky voters head to the polls Tuesday to choose a new governor, they'll also be deciding the future of the Bluegrass State's health care system.

Outgoing Gov. Steve Beshear (D), who is term-limited, embraced President Barack Obama's landmark health care reforms, making Kentucky the most politically conservative state to create its own health insurance exchange, known as Kynect, and to expand Medicaid to more poor adults living near the poverty line. Kentucky saw the second-biggest drop in its uninsured rate among all states since enrollment through the Affordable Care Act began two years ago. 

But Republican gubernatorial candidate and tea party favorite Matt Bevin has vowed to unravel Beshear's policies, meaning health coverage for hundreds of thousands of Kentuckians is at stake this Election Day.

About 400,000 Kentuckians have qualified for Medicaid coverage under the Affordable Care Act's more generous standards, and approximately 100,000 more signed up for private health insurance policies through Kynect, according to a spokeswoman for the Kentucky Cabinet for Health and Families. The share of Kentucky residents without health coverage fell more than 11 percentage points between the end of 2013 and June 2015, Gallup reported in August. Only Arkansas experienced greater improvement, with its uninsured rate declining by more than 13 percentage points.The federal exchange healthcare.gov struggled in the fall of 2013, while states like Hawaii, Oregon and others switched from their own exchanges to the federal sign-up system amid technological, logistical and financial troubles. But Kynect and Kentucky's Medicaid expansion are both regarded as successes, even by voters skeptical of Obamacare itself, surveys have shown.

"We've seen a drumbeat of positive stories about how many people have been added to insurance, the number of people who are now covered who were not covered before. We know the state has gotten a lot of positive publicity for it," said Steve Voss, a political scientist at the University of Kentucky in Lexington. "There certainly would be a lot of bad publicity as a result of scaling this back."

But Bevin staunchly opposes the Affordable Care Act on ideological grounds and has demanded its full repeal, consistent with the consensus view of Republican politicians nationwide. Bevin even painted Mitch McConnell (R-Ky.), the Senate majority leader and one of the law's chief antagonists in Washington, as soft on Obamacare when he unsuccessfully challenged the senator in a primary race last year.

Kentucky Attorney General Jack Conway (D) leads Bevin 43 percent to 41 percent, and Democrat-turned-independent candidate Drew Curtis trails far behind at 7 percent, according to a HuffPost Pollster analysis that also finds Conway has been ahead in the polls since September. The RealClearPolitics polling average shows Conway with a similar edge going into Election Day.

If Bevin defies these polls and emerges victorious Tuesday, his promises to roll back Obamacare in Kentucky could be tested as soon as he takes office. Ironically, the uncommon gubernatorial authority that enabled Beshear to implement the Affordable Care Act without having to go to the legislature could also empower Bevin to undo that legacy, despite Democrats controlling the state House of Representatives.

During his campaign, Bevin has remained steadfast in his vow to eliminate the Kynect health insurance exchange and direct Kentuckians to the federal system instead. But he has hedged on the Medicaid expansion, first saying he would end it entirely, then later suggesting he might seek unspecified concessions from federal authorities to simply scale it back instead.

"When a tea party Republican can't embrace rolling back what the Affordable Care Act has done, who can?" Voss said. "Not even this guy is willing to go to the mat for rolling back the Medicaid expansion. To me, that's your big story."
Bevin's apparent retreat from a wholesale repeal of the Medicaid expansion isn't necessarily a sign that his opposition to Obamacare has weakened, Voss said. Rather, it may merely reflect a growing understanding of the practical impact of abruptly taking away health coverage from hundreds of thousands of people.

"There has been an educational process for him as a campaigner talking to people with Republican sympathies but who are well-versed in health care policy that suggested maybe he needed more nuance," Voss said.Public opinion may not align with Bevin's aims, in any case. Less than one-quarter of Kentucky voters want the Medicaid expansion repealed -- including less than half of Republicans -- while 54 percent support leaving it in place, according to a Bluegrass Poll reported by the Lexington Herald-Leader last week.

Still, if Bevin were elected, his supporters would nonetheless demand he take action to curtail Kentucky's participation in the Affordable Care Act.

"The hostility to Obamacare is pretty well-ingrained in not just his party as a whole, but especially the wing of the party that's moving him into office," Voss said. "I think absolutely doing nothing and just continuing it the way that Democrats would would be politically devastating."

And favorable public opinions toward Kynect and the Medicaid expansion could change, Voss added, if Bevin made the case that Kentucky can't afford its share of the programs' costs and highlighted the negative aspects of Obamacare in the state.

"If he wants to be able to reverse what Gov. Beshear has done without paying significant political cost, he'd have to take the time to change the conversation before he altered the policy in any dramatic way," he said.

*GOP WANTS TO OUTSOURCE TAX COLLECTION TO THIRD PARTY DEBT COLLECTORS* - Paul Ryan can probably talk P90X with the thick-necked gentlemen named "Pretty" who show up on poor people's doorsteps. Zach Carter: "House Republicans are pushing to give private debt collectors the right to target all unpaid tax bills, handing a traditional IRS responsibility over to an industry with a long record of consumer abuse. *Debt collection agencies frequently get into legal trouble for intimidating or misleading borrowers over their debts. The GOP is advocating to empower them with tax debts as part of an effort to pay for highway funding without raising taxes*. The idea is that private debt collection companies will be more aggressive with tax delinquents than IRS agents, thus generating more money for the U.S. Treasury...When the Senate passed its version of the highway bill this summer, it included the measure to privatize tax debt collection. Conservatives Have A Big Night In Local And State Elections

Conservatives triumphed in high-profile local and statewide elections on Tuesday, with voters delivering big victories to Republican candidates and rejecting progressive ballot measures.

In the Kentucky governor's race, tea party favorite Matt Bevin (R) defied expectations and defeated state Attorney General Jack Conway (D), becoming the first Republican governor in more than 40 years. Bevin, a businessman, previously challenged Senate Majority Leader Mitch McConnell (R-Ky.) in a 2010 primary, but was trounced. This year's race was expected to be close, but Bevin's margin of victory was nearly 9 points.The GOP victory baffled many political observers in a state that, despite its conservative reputation nationally, often elects Democrats to local and state offices. Voters also selected Republican Mike Harmon for auditor, though Democrats eked out victories in two other statewide races: Andrew Beshear narrowly won the race to succeed Conway for attorney general, and incumbent Secretary of State Alison Lundergan Grimes, who unsuccessfully challenged McConnell in 2014, was re-elected.

Bevin's victory jeopardizes the fate of hundreds of thousands of Kentucky residents who have gotten health insurance under President Barack Obama's landmark health care law. The current Democratic governor, Steve Beshear, became an unlikely champion of Obamacare, establishing Kynect, the state's successful health care exchange, and expanding Medicaid. But with Bevin pledging to repeal and replace Kynect, the 400,000 Kentucky residents who qualified for Medicaid through the recent expansion may lose their coverage, as well as about 100,000 who obtained insurance through the state exchange.

Virginia, which held elections for its state legislature on Tuesday,  saw major GOP wins. The party retained control of the state Senate, despite the efforts of state Democratic leaders, including Gov. Terry McAuliffe, who fought tirelessly to turn some of the more competitive districts blue. With both of the state's legislative chambers controlled by Republicans, McAuliffe faces an uphill battle in passing progressive legislation, such as his recent push for gun control laws.
In another victory for conservatives, voters in Ohio failed to approve a ballot measure that would have legalized marijuana, though most pro-marijuana advocates did not openly lend their support because it would have restricted marijuana production to a few wealthy individuals.

On the local level, voters rejected several progressive ballot initiatives.

In Houston, voters overwhelmingly opposed Proposition 1, a non-discrimination initiative -- a huge loss for LGBT activists who campaigned for it. Many prominent Democrats, including Obama and Democratic presidential front-runner Hillary Clinton, endorsed Prop. 1, also known as Houston's Equal Rights Ordinance, or HERO.

HERO's opponents successfully thwarted the measure, in part through a fear-mongering ad campaign that claimed the measure, which would have protected against discrimination in public places, would have allowed male sexual predators to disguise themselves as women and enter women's restrooms.
Defying the growing national movement around raising the minimum wage, voters in Portland, Maine, struck down a measure that would have increased the city's minimum wage to $15 by 2017. Businesses argued that they were ill-equipped to implement it.

Gun rights advocates scored a win in Coos County, Oregon, whose voters authorized the sheriff to ignore federal and state gun laws, such as background checks, if he deems them unconstitutional. Constitutional law experts said the measure, called the Second Amendment Preservation Ordinance, is illegal.

One lesson for Democrats analyzing their losses: Many of the races suffered from low voter turnout and engagement, as off-year elections attract less attention. Traditionally, more Republicans turn out for midterm and off-year elections, giving them a built-in advantage.

For most people, their greatest financial asset is their job. But if you were unable to work as a result of an accident or illness, how would you and your family pay the bills? Savings can evaporate fast and parents or siblings may not be able to help.

The answer could be to plan ahead by taking out disability insurance. It can provide a much-needed safety net by replacing up to 70 percent of income. Yet few Americans even consider such a policy. In fact, disability insurance typically takes a distant third place after life and auto insurance:* *seven in 10 workers don’t have any long-term disability coverage.The chances that you'll need it, though, may be greater than you  realize. More than 25 percent of today’s 20-year-olds will become disabled before reaching age 67 according to the Social Security Administration. And 43 percent of all people age 40 will be sidelined for 90 days or more by age 65, according to data from the Insurance Information Institute.

Not all people become disabled due to an accident. According to the Council on Disability Awareness, about 90 percent of disabilities result from an illness such as cancer and diabetesAs medical bills pile up, the expenses have become the leading cause of personal bankruptcy, with three out of five bankruptcies due to loss of significant income as a result of illness. Even scarier, three-quarters of those bankrupted by medical debt actually had health insurance—it just wasn’t enough to replace their paychecks.

*Don't Rely on Social Security Disability Insurance*

Social Security Disability Insurance, or SSDI, or workers compensation might not provide a safety net. Consider these statistics from the Council for Disability Awareness:

· Some 65 percent of initial SSDI claim applications were denied in 2012.
· The average monthly benefit paid by SSDI by the end of that year was $1,130 per month.
· Because fewer than 5 percent of disabling accidents and illnesses are work-related, the other 95 percent are not covered by workers’ compensation.

*Insurance You Need*

To prepare for an emergency, you should have enough in savings to get you through the initial three to six months without income. After you run through the emergency fund, long-term disability insurance can be a lifesaver—the average disability claim lasts more than 31 months. Disability insurance is available in two forms:  

· *Short-term disability insurance* replaces a portion of your income during the initial weeks. Policies cover anywhere from a month up to a year of disability, providing income protection during the waiting period before long-term disability insurance kicks in. The major drawback: Short-term disability insurance is generally offered only through an employer.
· *Long-term disability insurance* pays benefits of up to 60 percent of your pretax salary from five years up to, ideally, age 67. Many larger employers provide long-term disability coverage, however only about one-third of workers have access to long-term disability insurance through their employer. Others may want to buy their own disability coverage. Furthermore, because employer-offered plans generally limit the benefit period, sometimes to as little as two years, you may wish to supplement your protection.The reassuring news is that the sooner you purchase long-term disability insurance, the less it will cost. Extending the period before you start receiving benefits will also lower the price. Generally, expect to pay between 1 and 3 percent of your salary.
