On Monday, August 18th, The New York Times (NYT) reported on a data breach suffered by Community Health Systems, which operates over 200 hospitals nationwide, that saw the compromise of 4.5 million records containing Personally Identifiable Information (PII) like names, phone numbers and social security numbers. According to Mandiant, who was engaged to investigate the incident, the belief is the attack emanated from an advanced group of cyber attackers based in China, who they say are more well known for targeting Intellectual Property, like advanced designs and research, rather than this type of PII. ObamaCare's Latest 'Accommodation' to Contraception Mandate: 'Insulting Accounting Gimmick' On Friday, the Obama administration issued its eighth “accommodation” to ObamaCare’s HHS contraception mandate, which requires most employers to provide free contraceptives, sterilization procedures, and abortion-inducing drugs to employees through their health insurance plans.

Lori Windham, Senior Counsel for the Becket Fund for Religious Liberty, which has represented many of the plaintiffs in their lawsuits against the Administration over the mandate, described the new rule in a press release as “the latest step in the administration’s long retreat on the HHS Mandate.”

In the wake of the Supreme Court’s Hobby Lobby decision, this latest revision of the mandate once again finds the Obama administration doubling down on presenting contraception as a highly prized, yet practically inaccessible – were it not for the government – commodity.

The announcement itself at HHS confirms this continued distortion: “Administration takes steps to ensure women’s continued access to contraception coverage, while respecting religious based objections.”

The statement maintains the Obama administration’s presentation of contraception as a product that women are “entitled to” under ObamaCare “at no additional cost.”

HHS Secretary Sylvia Burwell states, “Today’s announcement reinforces our commitment to providing women with access to coverage for contraception…”

How is it that the Obama administration gives “access” to contraception coverage when women have been walking into CVS, Walgreens, and Walmart for years and accessing it all by themselves, without “coverage?”

Contraception is, and has been, available, without a boss’s permission, for as little as $3.77 per month. In fact, up until 2012 when the HHS mandate came along, birth control had always been a private issue, and certainly never one that was considered to be pertinent to one’s job.

The latest revision of the mandate requires nonprofit organizations to provide written notification to HHS to state their moral objections to offering contraceptive coverage to employees. According to the rule, once it receives notification, HHS will then arrange that coverage for the employees, without involving the employers:



It provides that an eligible organization may notify HHS in writing of its religious objection to coverage of all or a subset of contraceptive services. The notice must include the name of the eligible organization and the basis on which it qualifies for an accommodation; its objection based on sincerely held religious beliefs to providing coverage of some or all contraceptive services (including an identification of the subset of contraceptive services to which coverage the eligible organization objects, if applicable); the plan name and type (i.e., whether it is a student health insurance plan within the meaning of 45 CFR 147.145(a) or a church plan within the meaning of ERISA section 3(33)); and the name and contact information for any of the plan’s third party administrators and health insurance issuers… A model notice to HHS that eligible organizations may, but are not required to, use is available at: http://www.cms.gov/cciio/resources/Regulations-and-Guidance/index.html#Prevention. If there is a change in any of the information required to be included in the notice, the organization must provide updated information to HHS…

When an eligible organization that establishes or maintains or arranges a self-insured plan subject to ERISA provides such a notice to HHS, DOL (working with HHS) will send a separate notification to each third party administrator of the ERISA plan. DOL’s notification will inform each third party administrator of the eligible organization’s religious objection to funding or administering some or all contraceptive coverage and will designate the relevant third party administrator(s) as plan administrator under section 3(16) of ERISA for those contraceptive benefits that the third party administrator would otherwise manage. The DOL notification will be an instrument under which the plan is operated and shall supersede any earlier designation. In establishing and implementing this alternative process, DOL is exercising its broad rulemaking authority under Title I of ERISA, which includes the ability to interpret and apply the definition of a plan administrator under ERISA section 3(16)(A).

 If an eligible organization that establishes or maintains an insured health plan provides a notice to HHS under this alternative process, HHS will send a separate notification to the plan’s health insurance issuer(s) informing the issuer(s) that HHS has received a notice under § 2590.715-2713A(c)(1) and describing the obligations of the issuer(s) under § 2590.715-2713A. Issuers remain responsible for compliance with the statutory and regulatory requirement to provide coverage for contraceptive services to participants and beneficiaries, and to enrollees and dependents of student health plans, notwithstanding that the policyholder is an eligible organization with a religious objection to contraceptive coverage that will not have to contract, arrange, pay, or refer for such coverage.



The Hill describes the new rule as an “action” that “amounts to an administrative workaround” that HHS is basing on a suggestion put forth by Supreme Court Justice Anthony Kennedy in the Hobby Lobby decision.

But Breitbart News’ Dan Riehl aptly reports that, as in all things with ObamaCare, “the devil is in the details.” And, of course, one of the main details is who will actually pay for the mandatory contraception “coverage” when those with religious objections opt out.

Riehl writes:



In short, the government will "step in" and cover "the law’s contraception requirements" as yet another taxpayer funded mandate. Also, as opponents charge, it doesn't actually get religious companies out of the birth control business, as they're still the vehicles for the coverage access.

If anything, this 'fix' only makes the so called law worse for everyone who pays taxes.



In addition, the ObamaCare law continues to be changed administratively, as Riehl notes, in response to court rulings and without any congressional intervention.

Arina Grossu, director for the Center for Human Dignity at the Family Research Council, referred to the new rule as an “insulting accounting gimmick” that “maintains the threat of crippling fines on non-profits who stand up for their freedom of conscience.”

“It is simply another clerical layer to an already existing accounting gimmick that does nothing to protect religious freedom,” she continues, “because the employer still remains the legal gateway by which these drugs and services will be provided to their employees.” Reported by Breitbart 6 hours ago.

However, as long as the federal government is subsidizing insurers billions of dollars in these exchanges, it should offer some of the money for beneficiaries’ direct use, via deposits in Health Savings Accounts, Health Reimbursement Arrangements, or Flexible Spending Arrangements, instead of handing it over to insurers. Many healthy, young people would surely prefer to spend money directly on medical care, rather than be forced to buy a health-insurance policy with a deductible so high they will likely never benefit from it. Apple Hints At A Push Into Health Care — Let's All Hope That Happens (AAPL) The United States’ health care system is extremely complex, but many doctors and experts believe it’s also inherently broken. 

Hospitals are routinely criticized for overcharging patients, while the drug and insurance companies continue to rake in mammoth profits. Meanwhile, individuals with lower income often lack sufficient access to proper health care.

Doctors and patients alike are unhappy with the current health care system, and a big part of that has to do with efficiency. In a Commonwealth Fund report published in June, the US ranked worst among 11 industrialized countries, particularly with regards to “efficiency, equity, and overall health of its citizens,” as CBS News points out. The US also spent more money on health care compared to the other 10 countries.

“The nation’s substantial investment in health care is not yielding returns in terms of public satisfaction or health outcomes,” the authors of the report said.

Congress has so far proved unhelpful with creating any meaningful change, but perhaps technology can cure some of our health care system’s inefficiencies.

Fitness wristbands are starting to gain traction with customers, but many believe Apple will be the first company to truly popularize health-oriented devices by making it easy for patients and their doctors to measure and track health data — while also offering a unique and stylish device. 

Apple is reportedly hard at work on its upcoming wearable device, presumably called "iWatch" or "iBand," which is said to measure health-related biometrics like heart rate and sleep quality, while also giving wearers the ability to control notifications and aspects of the smartphone experience right on their wrists. 

While that device waits in the wings, Apple has been busy striking partnerships with health institutions, hospitals, and health insurance companies around the U.S. to help develop and distribute its HealthKit software, announced in June, which will reportedly be a major part of the iWatch experience.

HealthKit, as Apple describes it, "allows apps that provide health and fitness services to share their data with the new Health app and with each other." The user can decide how much of their health-related information they want to share with third-parties.

But HealthKit isn't just for Apple devices; Apple announced an application programming interface (API) for HealthKit earlier this summer, which means medical companies that build equipment like heart rate or blood pressure monitors can hook their tools into this all-inclusive platform as well. The Mayo Clinic, which serves over 1.1 million patients each year, has already signed on to be an early partner in Apple's fledgling health initiative, among others (pictured below).

 

By teaming up with hospitals, Apple stands to benefit patients as well as medical practitioners, since doctors would theoretically be able to collect health data from their patients in between visits, which would lead to more accurate diagnoses and more efficient health care. A universal Apple app could also potentially facilitate doctor’s appointments and even prevent them entirely, if patients learn that their symptoms do not merit an actual visit to a physician or hospital.

Obviously, the HealthKit platform and the iWatch won't be the end-all solutions to the complicated and endemic problems that plague the U.S. health care system. But Apple, perhaps more so than any other company in America, is uniquely positioned to take on these issues.

When Apple does something — anything — people listen. And if Apple can make it popular to care for one's own health, other tech companies will surely jump on that bandwagon, as they always do. (Riding Apple's coattails is usually a safe financial bet.)

But aping Apple in this way would be a good thing: Tech companies can't prescribe medicine or conduct surgeries, but if they can collect and measure users' biometric data, they can offer preventative care — useful, personalized advice to heed before an issue becomes an emergency.

If people become more mindful about their own health statuses — and more importantly, know what to do about it — we might see emergencies decrease, as well as the number of doctor and hospital visits in general. That saves hospitals and ambulances a lot of money, and people get to save themselves from costly medical bills.

With fewer patients to address, doctors and hospitals could also spend more time on cases that truly need their attention, while those who saved themselves a hospital visit thanks to their health app can spend more time being productive instead of sitting in a waiting room for hours.

Tech companies likely won't change the foundational problems ailing the health care industry, such as the exorbitant cost of medical bills. But devices and services, like the ones Apple is purportedly working on, could help us avoid those bills completely.

Apple has never come out and said it wants to fix health care, but the proof is in the pudding.

Amidst news of Apple partnering up with hospitals and health organizations, CEO Tim Cook stopped by the VA Palo Alto Health Care System on Thursday, which is somewhat symbolic of Apple’s intentions to address health care. Veterans health facilities have faced intense scrutiny since May, when 40-plus military veterans died while waiting for care, which exposed deep-rooted problems within the health care system.

Cook obviously cares a great deal about health care personally. He's a noted fitness nut, and according to The Wall Street Journal, Cook once participated in a two-day cycling event across Georgia to raise money for multiple sclerosis, a disease that changed his life years prior when he was accidentally misdiagnosed with the condition.

(Cook also donated $50 million of his own money to Stanford hospitals in early 2012 — $25 million to build a new main building, and $25 million to build a new children's hospital.)

Apple may not be able to effect the political changes the U.S. health care system needs, but the company's forthcoming health-related technologies could help further expose the remaining inefficiencies and barriers that stand between doctors and those that need care.

SACRAMENTO, Calif. (AP) — Health insurance companies in California may not refuse to cover the cost of abortions, state insurance officials have ruled in a reversal of policy stemming from the decision by two Catholic universities to drop elective abortions from their employee health plans.

Although the federal Affordable Care Act does not compel employers to provide workers with health insurance that includes abortion coverage, the director of California's Department of Managed Health Care said in a letter to seven insurance companies on Friday that the state Constitution and a 1975 state law prohibits them from selling group plans that exclude the procedure. The law in question requires such plans to encompass all "medically necessary" care.

"Abortion is a basic health care service," department director Michelle Rouillard wrote in the letter. "All health plans must treat maternity services and legal abortion neutrally."

Jesuit-run Santa Clara University and Loyola Marymount University notified employees last fall that they planned to stop paying for elective abortions, but said faculty and staff members could pay for supplemental coverage that would be provided through a third party. The two schools said their insurers, Anthem Blue Cross and Kaiser Permanente, had cleared the move with the state.

University employees who objected to the decision and abortion-rights groups lobbied the women' caucus of the California Legislature, which in turn asked Gov. Jerry Brown to clarify and reverse the health care department's determination.

In her letter to the insurers, Roullaird said her department had "erroneously approved or did not object" to a small number of health insurance policies that excluded abortions. She asked the companies to review their plans, including any the department had already approved, to make sure they are in accordance with the new guidance.

The two insurance companies told the San Jose Mercury News (http://bit.ly/1t2Pjgu) that they would comply with the directive. Loyola and Santa Clara representatives said they would explore their options with Anthem Blue Cross and Kaiser Permanente.

Two groups that oppose abortion, the Life Legal Defense Foundation and Alliance Defending Freedom, sent a letter to Rouillard on Friday saying that under federal law California cannot force employers to cover elective abortions. The groups said they would file a civil rights complaint with the federal government unless the state's previous determination was reinstated.

"Pro-life employers have the freedom to choose health insurance plans that do not conflict with their beliefs on the dignity of human life," Life Legal Defense Foundation Legal Director Catherine Short said. "California cannot be allowed to discriminate against health plans that don't cover elective abortions and force people to purchase coverage that conflicts with their convictions." The Affordable Healthcare Act, known for its vague and ever-changing details, is sure to surprise many workers who underestimated their income or earned a larger income than estimated when they took Obamacare-related tax credits.
