The Democratic Party Needs Keith Ellison

The American people have faced stagnant wages and rising inequality for decades. Many Americans voted for Donald Trump or decided not to vote at all because Democrats failed to communicate effectively with working people and turn out the vote - end of story. The fact is that shouldn't have happened. The Democratic Party has long been the Party of working people, and needs to do a better job of making that case. No one knows this better than Keith Ellison, and we are proud to endorse him as the next Chair of the Democratic National Committee.

These are extremely challenging times. President Trump has put forward a nominee for Labor Secretary who openly disdains workers. Congressional Republicans are readying plans to roll back worker protections, repeal the Affordable Care Act and end Medicare as we know it. And in state capitals across the country, the assault on workers and unions has been fierce and swift. Now more than ever, working people need public servants who will stand up and fight for better jobs, higher wages, good benefits and a voice at work.

Keith knows how to win elections, and has a track record of defeating anti-worker forces wherever they are. When Keith was first elected to Congress in 2006, his district had the lowest turnout in Minnesota. Voters just didn't feel engaged. They didn't feel like they mattered. Keith decided to do something about it: he organized. He knocked on as many doors as possible. With labor at his side, he talked about the issues that mattered to people. It worked. Since Keith began his grassroots voter turnout campaign, his district is the highest performing in the state. And on top of all this, he's been getting pro-worker candidates elected from the school board to the U.S. Senate, traveling to nearly 30 states just last cycle.

When nurses went on strike to keep their health insurance, Keith was there. When communications workers went on strike to protest pension cuts, Keith was there. When hotel workers went on strike for a decent wage, Keith was there.


He hasn't done this alone. Keith has always organized alongside working people. He's marched on our picket lines and offered support to our members. When nurses went on strike to keep their health insurance, Keith was there. When communications workers went on strike to protest outsourcing and pension cuts, Keith was there. When hotel workers went on strike to stand up for a decent wage, Keith was there.

Each and every time, he's pounded the pavement, not for some sort of political benefit, but to stand in solidarity with those who want a better life for ourselves and our families.

That's who Keith is, and that's precisely why he's long been a friend of labor - especially in the halls of Congress. He's voted to increase the minimum wage, advocated for better working conditions and proposed a bill to make union organizing a civil right. As Co-Chair of the Progressive Caucus, he's used his microphone over and over again to speak up when unions or working people have come under attack. Simply put, labor has the strongest possible ally in Keith-someone whose primary focus is to create opportunity for all and grow the middle class, regardless of what you look like, where you were born, or who you are.

And now that he's running for DNC Chair, he's not wavering in his commitment to us--not one bit. He understands that many working people voted for Donald Trump because the Democratic Party didn't make a compelling enough case. He understands we are hungry for political leaders that listen to us and work with us, and that labor's agenda will always lead our politics, not the other way around. With Keith at the helm of one of America's two major political parties, working people will be in a much better position to have our issues advanced and our concerns heard.

Both of us have been a part of the labor movement for decades, and we wouldn't have it any other way. But we're not in the business of mincing words. Tough days lie ahead for working people. And so, it is more important than ever that we have a leader who will stand up, fight, organize and win.

There is no doubt in our minds: Keith Ellison is the person for the job. He has our strong support. We encourage you to give him yours, as well.

Gorsuch May Not Shift The Balance Of Power On The Supreme Court As Much As You Think Submitted by Michael Snyder via The Economic Collapse blog,

*On Tuesday, President Trump announced that he would nominate Neil Gorsuch to fill the open seat on the U.S. Supreme Court.*  Gorsuch currently serves on the 10th U.S. Circuit Court of Appeals in Denver, and he was confirmed unanimously by the Senate when he was appointed to that position by President George W. Bush in 2006.  Gorsuch appears to have some strong similarities to Antonin Scalia, and *many conservatives are hoping that when Gorsuch fills Scalia’s seat that it will represent a shift in the balance of power on the Supreme Court.*  Because for almost a year, the court has been operating with only eight justices.  Four of them were nominated by Republican presidents and four of them were nominated by Democrats, and so many Republicans are anticipating that there will now be a Supreme Court majority for conservatives.

*Unfortunately, things are not that simple, because a couple of the “conservative” justices are not actually very conservative at all.*

For example, it is important to remember that Scalia was still on the court when the Supreme Court decision that forced all 50 states to legalize gay marriage was decided.  Justice Anthony Kennedy joined the four liberal justices in a majority opinion that Scalia harshly criticized.  So with Gorsuch on the court, that case would still have been decided the exact same way.

*Sadly, even though Kennedy was nominated by Ronald Reagan, he has turned out to be quite liberal. * In the past, not nearly enough scrutiny was given to justices that were nominated by Republican presidents, and a few of them have turned out to be total disasters.

And let us also remember that Scalia was still on the court when the big Obamacare case was decided.  Chief Justice John Roberts joined the four liberal justices in a decision that was perhaps one of the most bizarre in the modern history of the U.S. Supreme Court.

*For some reason, Justice Roberts was determined to preserve Obamacare,* and if you read what he wrote it is some of the most twisted legal reasoning that I have ever come across.

As someone that was once part of the legal world, let me let you in on a little secret.  Most judges simply do whatever they feel like doing, and then they will try to find a way to justify their decisions.  So if you ever find yourself in court, you should pray that you will get a judge that is sympathetic to your cause.

Fortunately, *Gorsuch appears to be one of the rare breed of judges that actually cares what the U.S. Constitution and our laws have to say.*  In that respect, he is very much like Scalia…



Gorsuch is seen by analysts as a jurist similar to Scalia, who died on Feb. 13, 2016. Scalia, praised by Gorsuch as “a lion of the law,” was known not only for his hard-line conservatism but for interpreting the U.S. Constitution based on what he considered its original meaning, and laws as written by legislators. Like Scalia, Gorsuch is known for sharp writing skills.

 

“It is the role of judges to apply, not alter, the work of the people’s representatives,” Gorsuch said on Tuesday at the White House event announcing the nomination in remarks that echoed Scalia’s views.



One of the most high profile cases that Gorsuch was involved with came in 2013.  *That was the famous “Hobby Lobby case”, and it represented a key turning point in the fight for religious freedom.  *The following comes from CNN…



In 2013, he joined in an opinion by the full Court of Appeals holding that federal law prohibited the Department of Health and Human Services from requiring closely-held, for-profit secular corporations to provide contraceptive coverage as part of their employer-sponsored health insurance plans.

 

And although a narrowly divided 5-4 Supreme Court would endorse that view (and affirm the 10th Circuit) the following year, Gorsuch wrote that he would have gone even further, and allowed not just the corporations, but the individual owners, to challenge the mandate.



*Donald Trump said that he wanted a conservative judge in the mold of Scalia, but I think that he was also looking for someone that he could get through the Senate.*

And considering the fact that Gorsuch was confirmed unanimously by the Senate in 2006 will make it quite difficult for Democrats to block him now.  Gorsuch has tremendous academic and professional credentials, and he will probably have a smoother road to confirmation than someone like appeals court judge William Pryor would…



Trump may have favored Gorsuch for the job in hopes of a smoother confirmation process than for other potential candidates such as appeals court judge William Pryor, who has called the 1973 Supreme Court ruling legalizing abortion “the worst abomination of constitutional law in our history.”



*But Pryor is still reportedly on the short list for the next spot on the Supreme Court that opens up*, and by then the rancor in the Senate may have died down.

If Gorsuch is confirmed, what will this mean for some of the most important moral issues of our time?

*As for abortion, even if Gorsuch is confirmed I do not believe that the votes are there to overturn Roe v. Wade.*  But if Trump is able to nominate a couple more Supreme Court justices that could change.

But even if Roe v. Wade is overturned, it would not suddenly make abortion illegal.  Instead, all 50 states would then be free to make their own laws regarding abortion, and a solid majority of the states would continue to keep it legal.

*The analysis is similar when we look at gay marriage. * If the Supreme Court decision legalizing gay marriage in all 50 states was overturned, each state would get to decide whether gay marriage should be legal or not for their own citizens.  And just like with abortion, it is likely that only a limited number of states would end up banning gay marriage.

*So the nomination of Neil Gorsuch to the Supreme Court appears to be a positive step, but it does not mean that we are going to see dramatic change when it comes to issues such as abortion or gay marriage any time soon.*

But at least Gorsuch *can help stop the relentless march of the progressive agenda through our court system.*  So in the end we may not make that much progress for right now, but at least the liberals won’t either. Reported by Zero Hedge 22 hours ago.

Trump Suggests GOP Needs Until 2018 To Craft 'Wonderful' Obamacare Replacement

President Donald Trump seemed to suggest on Sunday that the Republicans’ replacement for the Affordable Care Act might not materialize until 2018. 

The statement, which Trump made in an interview with Bill O’Reilly of Fox News, could signal a significant setback in the effort to repeal and replace the 2010 law, which has helped 20 million people obtain health insurance ― and which is suddenly showing some political resiliency.

Trump has stated previously that Congress should pass its Obamacare replacement plan at roughly the same time that it acts to repeal the law ― in part, so that people who now depend on it for coverage will know what they’re getting instead.

Trump has also said that he wants both steps to take place this year, ideally “very quickly.” At one time, both he and congressional leaders were suggesting that they hoped the repeal could take place within weeks, if not days, of Trump taking office.

That period is passing quickly, with no GOP health care plan in sight. And on Sunday, Trump was talking as if the party still needs a lot more time.

Toward the end of the Fox News interview, which aired in part just before the Super Bowl, O’Reilly asked Trump whether Americans can “in 2017 expect a new health care plan rolled out by the Trump administration ― this year?”

Here was Trump’s full response:

Yes, in the process and maybe it’ll take till sometime into next year, but we’re certainly going to be in the process. Very complicated ― Obamacare is a disaster. You have to remember Obamacare doesn’t work, so we are putting in a wonderful plan. It statutorily takes a while to get. We’re going to be putting it in fairly soon. I think that, yes, I would like to say by the end of the year, at least the rudiments, but we should have something within the year and the following year.

The usual caution applies here. Trump could have been talking about the time necessary to implement a new health care plan, rather than simply pass the blueprint through Congress. And even if he was talking about the time to pass legislation, he could have been speaking off the cuff.

It may be only a matter of time before his aides or allies rush to the microphones to “clarify” the president’s remarks and insist that the introduction and enactment of a Republican alternative to the Affordable Care Act is imminent.

But there’s good reason to think that Trump really did mean it would take longer to produce a bill ― and that, in this instance, he was reacting to information he’s received from leaders on Capitol Hill and from his own advisers. 

Even before Trump spoke to O’Reilly, it was becoming clear that the effort to wipe away President Barack Obama’s signature domestic policy accomplishment was running into serious trouble. Despite nearly seven years of promising to come up with an alternative health care plan, Republicans are nowhere near agreement on how to craft one.

The problem for Republicans is that they’ve committed themselves to several goals that are almost certainly impossible to reconcile with one another. At various points, they have vowed to come up with a system that can provide, as Trump has put it, “great health care for much less money.”

Nearly any health care system that offers substantially less spending by the government is likely to lead to fewer people insured, less generous coverage for people who have it, or both of those things.

While the Affordable Care Act has plenty of shortcomings and no lack of people unhappy with its results, it has also provided financial and medical security to millions. Republicans have yet to produce a plan that could replicate those gains.

Within a few weeks of the November election, the Republicans who knew the most about health policy, such as Sen. Lamar Alexander (R-Tenn.), began to warn about this problem ― and to suggest that perhaps the party should move slowly on replace and repeal. At a GOP retreat in Philadelphia a little more than a week ago, lawmakers talked openly about their confusion on how, or even when, to proceed.

Meanwhile, Republicans have faced an increasingly intense political backlash from Obamacare’s defenders. Just this weekend, two GOP congressmen from relatively conservative districts confronted loud protesters at town hall meetings in which the Affordable Care Act was a major topic of discussion.

Make American Jobs

President Donald Trump had Harley-Davidson executives and employees over to lunch at the White House last week and reiterated his promise to end wrong-headed trade policies that enable foreign countries to eat American workers’ lunch.

The president reassured the Harley workers from the United Steelworkers (USW) union and the International Association of Machinists (IAM) that he would renegotiate NAFTA and other trade deals.

“A lot of people [have been] taking advantage of us, a lot of countries [have been] taking advantage of us, really terribly taking advantage of us,” he said as news cameras clicked, “We have to be treated fairly.”

No promise could be more heartening to workers as corporations like Carrier and Rexnord continue to move jobs to Mexico. No news could be better in the same week that the Economic Policy Institute (EPI) released research showing that since 2001, the United States’ massive trade deficit with China cost 3.4 million Americans their jobs.Workers, families and communities have suffered as trade and tax policy over the past quarter century encouraged corporations to off-shore factories and jobs. Flipping that philosophy to favor American workers and domestic manufacturing is exactly what labor organizations like the USW have long fought for. If President Trump actually achieves that, all Americans will benefit.

In the meantime, Rexnord Corp. has finalized plans to uproot its bearings manufacturing machines in Indianapolis, transport the equipment to Mexico and throw 300 skilled and dedicated workers, members of my union, the USW, into the street. Terminations begin Feb. 13.

Automation did not take these workers’ jobs. The lure of dirt-cheap wages in Mexico and tax breaks awarded for the costs of moving jobs and machinery stole them.

President Trump talked Thursday to the Harley workers and executives about changing tax policy. Ending all special tax deals and loopholes that corporations like Rexnord and Carrier use for shuttering American factories and shipping them to other countries would be a good first step. U.S. policy shouldn’t reward corporations like Rexford and Carrier that profit from exploiting the international wage race to the bottom and the wretched environmental regulation of emerging nations.

The next logical step would be establishing consequences for those corporations – like requiring them to pay substantial economic penalties if they want access to the U.S. market for their once-domestic and now foreign-made products.

In addition, American policy must be – just as President Trump promised in his campaign – to stop trade law violators who are trampling all over American workers.

The EPI study detailed the devastation caused by the worst violator – China. American workers and companies can compete on a level playing field with any counterpart in the world. But the EPI study shows just how much American workers and their employers suffer when the United States fails to strictly enforce international trade law.

Of the 3.4 million jobs lost between 2001 and 2015 because of the U.S. trade deficit with China, EPI found that nearly three-quarters of them, 2.6 million, were manufacturing jobs. Every state and every Congressional district was hit. These are jobs fabricating computer and electronic parts, textiles, apparel and furniture.Manufacturing jobs such as these provide family-supporting wages and benefits such as health insurance and pensions. As these jobs went overseas, American workers’ income stagnated while those at the top – executives, 1 percenters and corporate stock holders – benefitted.

As the rich got richer, the EPI researchers found that all non-college educated workers lost a total of $180 billion a year in income.

When the United States agreed to allow China into the World Trade Organization (WTO) in 2001, former President Bill Clinton said the access that the deal provided American companies to the gigantic Chinese market would create jobs. Promises, promises.

It’s possible no one guessed just how massively China would violate the trade rules it agreed to abide by under the WTO pact. Numerous investigations by the U.S. Department of Commerce have found China improperly subsidizes its exports by providing artificially cheap loans, free land, and discounted raw materials and utilities. To keep its workers employed, China helps finance overproduction in industries like steel and aluminum, then dumps the excess at below-market prices in the United States, bankrupting mills and factories here.

China pirates innovation, software and technology from foreign producers. To steal trade secrets, its military hacked into the computers of American corporations and the USW. In addition, China has manipulated the value of its currency so that its exports are artificially cheap and imports from the United States are artificially expensive.

Even if the scale of violation was underestimated, when it occurred, the American government had a responsibility to take action, to file trade cases, to take issues before the WTO, to negotiate to bring China in line with international standards and protect American jobs and preserve domestic manufacturing, which is crucial to national defense.

Precious little of that occurred. The trade deficit with China exploded, obliterating American jobs, a quarter million on average every year since China joined the WTO in 2001. China exports to the United States its overproduced aluminum, steel, and other commodities, but also its unemployment.

After lunch on Thursday, President Trump thanked Harley-Davidson for assembling its iconic motorcycles in America. He extended his hand in aid, saying, “We are going to help you, too. We are going to make it really great for business, not just for you, but for everybody. We are going to be competitive with anybody in the world.”

American workers and domestic manufacturers already are competitive. What they need is a government that doesn’t require them to compete with a handicap so huge that it’s like asking Evel Knievel to jump his Harley-Davidson XR 750 over 19 cars without a ramp. Veteran To Donald Trump: This Is 'Not The America I Sacrificed For'

A new ad by the group VoteVets features a veteran speaking directly to President Donald Trump about his efforts to repeal Obamacare and limit Muslim immigration to the United States.

The ad shows an Afghanistan war veteran, who lost a leg in combat, working out. As he does weighted squats, he addresses the president in a voice-over.

“Look, you lost the popular vote. You’re having trouble drawing a crowd. And your approval rating keeps sinking. But kicking thousands of my fellow veterans off their health insurance by killing the Affordable Care Act and banning Muslims won’t help. And that’s not the America I sacrificed for,” he says in the ad, which aired during MSNBC’s “Morning Joe” on Monday. “You want to be a legitimate president, sir? Then act like one.”

According to a press release from VoteVets, Trump tweeted three minutes after the ad made its debut.

About 45 million Americans did not fill a prescription in 2016 due to the costs of pharmaceuticals, a new analysis by Prescription Justice shows, with 18% of adults reporting this problem in a recent survey. This rate of foregoing medicine due to cost is nine times higher than in the United Kingdom, where medicine is largely covered by national health insurance. The analysis conducted by Prescription Justice —a non-profit organization dedicated to tackling the crisis of high drug prices — is based on data extracted from the Commonwealth Fund’s 2016 International Health Policy Survey of Adults.

“Americans cannot afford to wait a day longer for drug price relief,” said Jodi Dart, Executive Director of Prescription Justice. “Tens of millions of Americans are not taking medications because of high drug prices. We urge President Trump to keep his campaign promise to stand up to big pharma and bring relief to millions of Americans who are unduly suffering because they can’t afford the vital medications that will help them get better.”

The data also show a likely link between the advent of the Affordable Care Act and the percentage decrease in people who have had to forego prescription medication due to cost in recent years. Prior to ACA implementation, 21% of Americans reported not filling prescriptions due to cost. That number has dropped three percentage points since the Affordable Care Act took effect in late 2013.

A previous estimate of the number of adult Americans who did not fill a prescription because of cost was 35 million, which was based on an earlier Commonwealth Fund Survey from 2014, which only involved adults ages 18-64, not all adults ages 18 and over, including elder Americans, as included in the new survey.

Prescription Justice has published a proposal recommending that the Trump Administration take immediate executive actions, as permitted under current law, to expand access to lower cost, safe personally imported medications: an action supported by Mr. Trump during his campaign. As described in the proposal, Americans can often obtain medications at just 10% of the U.S. cost by purchasing them from international online pharmacies dispensing from licensed pharmacies in other countries, such as the UK and Canada. Annually, about four million Americans, according to U.S. Centers for Disease Control and Prevention data, already import medication for personal use each year. Nineteen million Americans have said they have done so, according to the Kaiser Family Foundation. Despite federal restrictions no serious adverse events have been reported by patients who imported medication with a valid prescription, according to Prescription Justice.

The Centers for Disease Control (CDC) estimates that as many as 70% of hospital-acquired cases of VTE are preventable, making the need for hospitals to improve awareness and develop new processes acute. In honor of American Heart Month, Vocational Rehabilitation shares the story of a young man who went through three open-heart surgeries in his short life and still found his first job.

When Shawn Burrows heads to work each day, he does it without complaint – in fact, a smile stretches across his face as he enters Wuesthoff Hospital in Rockledge. For Shawn, who has had three open-heart surgeries due to a pulmonary valve disorder, having a job has changed his life. His condition must be monitored and requires multiple medications, but that doesn’t stop him from excelling as a materials management technician at Wuesthoff.

Shawn got the job with the help of Vocational Rehabilitation (VR), a federal-state agency that helps people with disabilities get or keep jobs. He first came to VR as a senior in high school, unsure of what he wanted to do after graduation. VR Counselor Lynda Schuchert met with him and went over his options. Shawn decided he wanted to work, so Lynda suggested a volunteer position at Wuesthoff Hospital.

Though he was hesitant to work at a hospital after spending so much time in operating rooms for his surgeries, he agreed to start volunteering at Wuesthoff because it was a special place for him. “My grandmother worked there as a manager in the dietary department, so I wanted it to be a family thing,” Shawn explains.

He spent time working in the materials management department, which supplies necessary items to employees throughout the hospital. “It’s like a store,” Shawn says. “Hospital workers send us requests for items, and we fill the orders. We also stock the shelves and keep the store clean.”

Shawn quickly found that he liked the work. His supervisor noticed his exceptional performance and offered him a part-time position. After a few months working part-time, Shawn’s hours have increased to almost 40 hours a week. His hours are flexible, in case he has any medial issues, but so far, he’s still going strong. He now makes enough money to cover the cost of his own health insurance and to pay the rent for his own apartment.

Shawn has surprised himself and his parents with how well he is doing in his new job. “His boss says he’s just a god send, they love having him here,” says Lynda. “They’re trusting him more, and he’s responsible for doing more things on the job.”

“The last six months, he’s been more outgoing,” shares Lynda. “He was living with his dad and now he lives with a friend, and he got his driver’s license so he’s driving himself to work. It’s really cool that he came in not knowing what he wanted to do, and now he’s just doing it.”

Shawn is having so much fun working at the hospital that it’s tough for him to pick his favorite part of the job. “Honestly, all of it,” he says. He also plans to stay in his job for the long term. He is grateful for his job and for those who have helped him along the way. “I had to go through all of these steps to try and get a job, and VR helped me with every single one,” he says.

In the future, Shawn plans to go to college to become a doctor or nurse. This is the same young man who didn’t know if he could work at all because of his disability, who is making plans for a future that includes a career in his now chosen field.
